Powers-of-Attorney – Both general (financial/property) and medical are legal documents that are both necessary and sometimes evil. These legal documents are often misused to both inadvertently and more and more often, intentionally separate the elderly from their life savings. Yet, their proper drafting and execution is essential to good planning for every one of us no matter what age we may be, and all the more so as one ages and the specter of incapacity or disability grows.
Basics include what is a POA? What kinds of POAs can one have and what must they say, what are the formalities required to execute them in Virginia? Is it okay to just download a form from the internet? Then we will get into some of the finer points: what can the agent do under the authority of a POA? When is an agent misusing their authority? What can be done about it?  And so much more!
