This session will discuss how negotiate effective settlements in civil cases. The basic text will be “How to Negotiate the Best Settlement” that has been presented by Michael V. Cory, Jr., and is used with permission of that author. Those ideas will be discussed at the various stage of each case, pre-suit, pre-trial, and post-trial. Emphasis will be placed on communication with the client, including managing expectations, providing information, and finding resolutions that make the client happy. The session will also cover considerations to settlement whether the venue is state court, federal court, or arbitration, and whether or not formal mediation occurs.
